Terms of Service

Welcome to BeatMe! These Terms of Service ("Terms") govern your use of the BeatMe mobile application and related services (collectively, the "Service") operated by BeatMe ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms.

2. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

3. Use of the Service

BeatMe is a social sports platform that allows you to:

• Create and accept challenges with friends
• Record match results for badminton, tennis, and pickleball
• Track your skill-based rankings over time
• Connect with other players in your community

You agree to use the Service only for lawful purposes and in accordance with these Terms.

4. Prohibited Conduct

When using the Service, you agree NOT to:

• Violate any applicable laws or regulations
• Impersonate any person or entity, or falsely state or misrepresent yourself
• Submit false or misleading match results to manipulate rankings
• Harass, bully, threaten, or intimidate other users
• Post or transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the Service or other accounts
• Use automated systems, bots, or scripts to access the Service
• Interfere with or disrupt the Service or servers
• Collect or harvest user data without authorization
• Use the Service for any commercial purpose without our consent
• Circumvent any security or access controls

5. Fair Play Policy

BeatMe is built on the principles of friendly competition and sportsmanship. By using the Service, you agree to:

• Report match results accurately and honestly
• Accept both wins and losses gracefully
• Treat other players with respect and sportsmanship
• Not manipulate rankings through fake matches or collusion
• Report any suspicious activity or cheating to us

Violations of this Fair Play Policy may result in ranking penalties, temporary suspension, or permanent ban from the Service.

6. User Content

You may be able to submit content to the Service, including profile information, match data, and communications with other users ("User Content").

You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and providing the Service.

You represent that you have all necessary rights to submit User Content and that it does not violate any third-party rights or applicable laws.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BeatMe. The Service is protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by BeatMe. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that BeatMe shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

BeatMe is a platform for tracking recreational sports activities. We are not responsible for any physical injuries that may occur during your sports activities.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEATME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless BeatMe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Termination

You may terminate your account at any time by deleting your account through the app settings or by contacting us at support@beatme.vn.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Vietnam.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the other provisions of these Terms will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeatMe regarding the Service and supersede any prior agreements.
